Terms of service

1. Agreement
These terms of service (“Terms”) govern access to and use of the podcast hosting and distribution service offered by Cubecast at https://cubecast.fr (the “Service”). By creating an account or using the Service, you agree to the then-current Terms.
2. Account
You must provide a valid email address and a strong password. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorised use at support@cubecast.fr.
3. Permitted content
The Service is intended for hosting and distributing podcasts and related audio (episodes, extras, trailers) plus associated metadata (titles, descriptions, RSS artwork), provided the material is lawful and you have the rights and permissions you need.
- speech, information, culture, education or entertainment that complies with applicable law;
- promotional or advertising segments within your show, subject to competition law and sector rules;
- reasonable use of the resources included in your plan (storage, bandwidth, API).
You remain solely responsible for what you publish and for third-party rights (intellectual property, image rights, privacy).
4. Prohibited content and uses
You must not use the Service to host, distribute or facilitate, in particular:
- any content that is illegal under French law, EU law or other applicable law;
- child sexual abuse material or sexual content involving minors;
- hate speech, incitement to violence or terrorism, or glorification of serious crime;
- content that severely undermines human dignity, systematic harassment, or calls for violence against people;
- distribution of malware, phishing or material designed to deceive users;
- infringement of intellectual property (works, sound recordings, trade marks) without the rights-holder’s permission;
- invasion of privacy or misuse of others’ personal data without a legal basis (non-consensual intimate recordings, doxing, etc.);
- spam or bulk unsolicited outreach abusing the Service or feeds;
- attempts to compromise security (intrusion, abusive load, circumvention of technical controls);
- resale or redistribution of the Service in breach of these Terms or the law.
We may remove content, suspend or close accounts, cooperate with authorities and retain information where required for disputes or legal obligations.
5. Abuse reports and content removal
To report manifestly illegal content, abuse of the Service or an infringement of your rights, email abuse@cubecast.fr. Please include, where possible, the podcast or RSS URL, a short description of the issue and contact details so we can process the report. We review good-faith reports within a reasonable time. Account, billing and product questions go to support@cubecast.fr. Personal data practices are described in our privacy policy.
6. Availability and changes
We aim for reasonable availability but do not guarantee uninterrupted or error-free operation. The Service may change (features, limits, pricing). We will give notice where required by law or good commercial practice.
7. Plans and payment
Some features may require a paid subscription. Prices, applicable taxes and payment methods are shown before you confirm checkout. Payments are processed by Stripe; Stripe’s terms may apply in addition. You may manage or cancel your subscription through the panel or Stripe’s customer portal where available.
8. Intellectual property in the Service
Our name, software, interface and documentation remain our property or our licensors’. We do not claim ownership of your podcast content, subject to the limited rights needed to host, transcode, deliver via CDN and display it as part of operating the Service for you.
9. Privacy
Personal data processing is described in our privacy policy.
10. Limitation of liability
To the fullest extent permitted by applicable law, Cubecast is not liable for indirect damages, loss of data, revenue or audience, or for user- or listener-generated content. Our aggregate liability for all claims arising out of the Service in any twelve-month period will not exceed the fees you paid us for the Service in that period (or zero if you only use a free plan), except where mandatory law provides otherwise (e.g. gross negligence or wilful misconduct).
11. Termination
You may stop using the Service and request account deletion. We may suspend or terminate accounts for breach of these Terms, non-payment or legal requirements. Provisions that should survive (liability, IP, disputes) will remain in effect.
12. Governing law and disputes
Unless mandatory consumer rules say otherwise, these Terms are governed by the laws of France. Courts with jurisdiction will be those determined by applicable law or, where permitted, at the seat of Cubecast, without prejudice to mandatory consumer jurisdiction rules.
